CONDITIONS OF PARTICIPATION
1. TERMS AND CONDITIONS
These terms and conditions apply to the competition "Win your own personalized casserole" (hereinafter referred to as the "Competition"), organised by The Cookware Company Europe BV, with its registered office at Antoon Catriestraat 12, 9031 Drongen, Belgium, registered with the central company database (The Crossroads Bank for Enterprises (BCE/KBO)) under number 0635. 907.452 hereinafter referred to as "The Cookware Company Europe”.
By entering the competition, each participant confirms that he has read and understood these terms and conditions and accepts them. Furthermore, each participant accepts that the decisions made by The Cookware Company Europe regarding the competition are binding.
2. CONDITIONS OF PARTICIPATION
Eligible to participate are all persons over 18 years of age and whose residence is in Europe.
If a participant does not fully comply with the conditions of participation (even if he/she wins the competition), he/she will automatically lose his/her prize without any right to compensation or appeal.
3. PROCEDURE AND IMPLEMENTATION OF THE COMPETITION
The Competition begins on 05.12.2021 17:00 and ends on 10.12.2021 11.00.
To enter the competition, participants must :
- Follow @moods.at.home on Instagram
- Like the post mentioning the competition
- Share the post on their story
- Tag a friend & mention in the comments what the participant would prepare, using their own personalized casserole.
10 winners will be chosen on 10.12.2021 by The Cookware Company Europe. The winners will be notified the same day by direct message on Instagram and asked to provide their home address, the name they want to have engraved on the enameled casserole, and their preferred color of casserole (2 options: blue & green). The prize will be delivered to the address provided within 15 working days of this notification. Winners will be required to provide all information requested by The Cookware Company Europe within 2 days of receipt of the notification.
The result of the competition is binding and irrevocable and cannot be contested.
4. THE PRIZE
The prize for the winners is a personalized casserole worth € 124.99 (hereinafter referred to as "prize"). The prize does not include any additional products or services. It is not transferable and cannot be exchanged for cash. The winner shall be responsible for all costs and obligations relating to the Prize, including (but not limited to) taxes.
The Cookware Company Europe reserves the right to provide an alternative prize in the event of production problems or other (technical or other) problems related to the prize.
5. ADMINISTRATION OF THE PRIZE DRAW
The Cookware Company Europe manages the proper conduct of the competition. Failure to comply with these terms and conditions or in the event of misrepresentation or deception by the winner will automatically deprive the winner of his or her right to the prize, without any compensation being due to The Cookware Company Europe. In such a case, The Cookware Company Europe reserves the right to demand the return of any prize already awarded and to claim compensation for any damage (including damage to its image) resulting therefrom. Only if this is (still) reasonably possible will The Cookware Company Europe select a new winner.
6. LIABILITY
Subject to legal provisions, The Cookware Company Europe can only be held liable for damages caused by gross negligence, intent, fraud or deception. The Cookware Company Europe is not liable for any other fault, but only for direct damages and never for indirect damages, including (but not limited to) consequential damages, loss of profit, loss of savings or damages to third parties. The Cookware Company Europe cannot under any circumstances be held liable for any damage caused by improper or illegal use of the prize by the winner.
Notwithstanding the foregoing, The Cookware Company Europe shall not be liable for:
late delivery or non-delivery of the Prize if the Winner has not given the correct delivery address;
any errors made by third parties including (but not limited to) transport service providers; spelling mistakes or other errors or technical problems. If the Competition is disrupted due to a technical problem (including, but not limited to, communication line failure and transmission delays), The Cookware Company Europe will do everything possible to remedy the situation.
7. PRIVACY POLICY
The privacy policy explains how The Cookware Company Europe processes the personal data of participants.
8. CHANGES TO THE TERMS OF PARTICIPATION AND CANCELLATION OF THE COMPETITION
The Cookware Company Europe reserves the right to amend these terms and conditions or to postpone, shorten or cancel the competition in case of force majeure or if this is justified by circumstances beyond the control of the company, in particular if the proper execution of the competition cannot be guaranteed for technical or legal reasons.
In the event that one or more of the provisions contained herein are held to be invalid, illegal or unenforceable for any reason, such invalidity, illegality or unenforceability shall not affect any other provision of these terms and conditions.
9. APPLICABLE LAW
These terms and conditions are governed exclusively by the law.
